Hi Trampie. In short, no, I don't agree. As I said in my post, based on what I've seen and read, the verdict is entirely plausible and reasonable.
The adversarial trial system has its drawbacks, but in the main it delivers good outcomes and is better than anything else I've seen. By good, in the main more guilty people go free than innocent people get punished. Money often talks of course, and usually money is thrown at the best defence teams. I think it's safe to assume that Ched with his financial history wasn't struggling by on legal aid.
Most of the examples on here are to say I got drunk at uni and never asked for consent from a drunken girl staggered home with, and think that is a good parallel for this case. They forget its a good parallel for the defendant who was found NOT guilty.
The defendant who was found guilty slipped into a hotel room on false pretences, had sex with a barely conscious female he did not know, before slipping out of the fire escape afterwards. That's not usual conduct after a night out at the Students Union - or maybe my Uni days were less exciting than those on here. |
You don't agree that to some people its a questionable verdict ?, yet you set out reasons why it could be seen as a questionable verdict.
You might think the verdict is sound but not all people agree, if the level of proof that sent Evans to jail is the norm then little wonder there seems to be more and more convictions for sex crimes which would be a good thing if they are all guilty but a bad thing if its the other way around. |  |

Why can't you see that?
That's what juries are there for - to convict on the evidence provided - whether it's 100% proof or not.
A good local example would be the bloke who was locked up for the murder of a family of four women in Clydach in the 80's.
As far as I recall there was no clear, incontrovertible proof, no DNA evidence, no witnesses etc. And I don't recall there being an outcry in that case. |

There doesnt have to be 100% proof but proof beyond reasonable doubt. Which is close to 100%. Balance of probability is reserved for civil cases not criminal.

However, I trust the jury on this one - possibly, if I'm honest, because I'm predisposed to after years of reading about how the justice system has been stacked against rape victims for years. It's this latter fact that makes my blood boil - not the very faint possibility that Evans may be innocent.

Yes but sentenced within the bounds of beyond reasonable doubt.
I had to tell an English board about the Suarez/Terry cases, a highbrow board with apparently politicians, professionals, educated people etc etc but they had no concept of different laws and the balance of probabilities.
Suarez should not have been charged by the English FA and was [Evra incident] and they would find him guilty when they should not have - it happened as I told that board.
Terry taken on by the law, not guilty.........hmm, but would have to be found guilty by the English FA who found a Uruguayan guilty [for less many would say], people could not understand that Terry having got off in a court of law would have to be charged by the FA and found guilty [when the law did not find him guilty] and given at least as stiff a sentence as Suarez was - it happen just as I told that board that it must happen.
I was called everything but I was correct all the way down the line, people just didn't know the different tests and how different bodies work.
Now should Evans have been found guilty ? [after all I would have thought that a crown court would have a very high level test to attain a guilty verdict], I would say it was a big call by the jury, they may have got it right who knows, but it seems like a big call to quite a few observers.
PS Clydach 80's [family of 4] ????, you a way out with your dates, also there has been lots of controversy over the outcome which is still being talked about today. [Post edited 8 Jan 2015 21:07]

And how did the person who said those words come to that conclusion.
If I said "the defendant won the lottery and spent it all on wine gums" does that mean he did? That sounds like someones view who was not present basing their opinion on very sketchy evidence, so sketchy not one single person dare cite it as evidence on here, nobody.
What you have done there is admitted that your opinion is not based on the case at all but indeed your view of footballers in general and how the justice system is stacked against rape.
