judd put me onto the case of Optimus Build Limited vs Matthew Southall which is interesting given that it was claimed in the MEN that Matthew Southall had an exclusive deal with Morton House
Southall's builder took him to court over a mass of unpaid monies that, based on records in the public domain, are still outstanding.
Interestingly, Southall's tactics throughout appear to have been to threaten and bully this poor builder into giving in, claiming that the builder has committed fraudulent representation.
You can read it for yourself but midway thorough the judge says:
"It was apparent from Mr Southall's evidence generally that he could be capable of expressing himself forcefully when crossed or contradicted and I accept her account that he did so on that occassion.
As he said at one point in cross-examination "you only get one chance with me""
You've got to feel sorry for the builder who comes across as an honest bloke doing the best for his client but that client didn't actually want to pay him in full for the work done.

The M.E.N. understands that Mr Southall was approached by an intermediary on behalf of Morton House, who were looking to off-load the 42 per cent of shares in Rochdale acquired when the group was attempting to take control of the Crown Oil Arena club.
I sincerely hope that Curran / Rose / Morton House have seen some actual cash for that 25% and not on the never-never!

One thing that has struck me ever since Matt Southall's PR machine came out in the Manchester Evening News is how his "bid" might upset his lost court case and the charges that are on the house in Leigh Road in Worsley.
The land registry charge shows that 264 Leigh Road, Worsley owes money in order to:
* Together Finance Limited - a mortgage Company * Academy Leasing Limited - a finance provider for vehicles * Optimus Build - a provider of building services
Take the value of the house and deduct what is owed to those three parties and Jade McManus and Matthew Southall get to keep what is left.
Rightmove suggests the house is worth around £875,000. The land registry deed suggests £900,000.
Now think back to the Morton House deal.
Morton House stated in the Manchester Evening News via the Scouse Disaster Alexander Jarvis that "over £1 million to date in consideration for shares, due diligence and legal costs."
25% from Southall is a tactical threshold. One would assume that Morton House would try to keep the rest and the two would work together.
After all - Andrew Curran and Matthew Southall were seen by half the town of Rochdale declining a delicious chip barm from the Wilbutts Lane chippy in late April - Fat Pat is still fuming that one of the louts called her "greasy Fat Pat". Little did they know.
So where is Matthew Southall getting £1,000,000 from to give to Curran for the 25%? We assume:
(1) rightly that recently FA banned Andrew Curran isn't giving these shares away having put £1m into them (2) Southall doesn't have any funds or else why WOULDN'T he pay off his leasing company and his builder? (3) Southall finding a big wedge of cash to even think about buying 25% of Rochdale would need more money to inject and sell to us the dream of [bMatt Southall's Barmy army.
It makes no sense.
The team at Optimus Build even went as far as being matchball sponsor for the ITV/Plymouth game on 5th December - looking at this picture of the Chairman a good time was had by all - except poor Aaron Morley who had scored that day!
Maybe a matchball sponsorship was all it took to join up all the dots?

When the building firm has a debt which is secured on the family home!

Just a small correction RAFCBlue - MH invested £1M+ for the original (now diluted) 43%, so the payment they would be looking for the (now diluted) 25% would be in the region of £600k, not £1M. Pretty irrelevant, I know, if the payment will not be forthcoming.....for whatever reason.

Didn’t Matt southall agree to purchase 25% before they were diluted? Therefore he will still be buying the same number of shares, presumably at the price he agreed with Morton house, just now they only equate to approx 12.5%.
