judd put me onto the case of Optimus Build Limited vs Matthew Southall which is interesting given that it was claimed in the MEN that Matthew Southall had an exclusive deal with Morton House
Southall's builder took him to court over a mass of unpaid monies that, based on records in the public domain, are still outstanding.
Interestingly, Southall's tactics throughout appear to have been to threaten and bully this poor builder into giving in, claiming that the builder has committed fraudulent representation.
You can read it for yourself but midway thorough the judge says:
"It was apparent from Mr Southall's evidence generally that he could be capable of expressing himself forcefully when crossed or contradicted and I accept her account that he did so on that occassion.
As he said at one point in cross-examination "you only get one chance with me""
You've got to feel sorry for the builder who comes across as an honest bloke doing the best for his client but that client didn't actually want to pay him in full for the work done.

Matt Southall has gone as quiet as a church mouse.
Let's all hope he disappears completely his type just not welcome at a family club like Rochdale. Thank goodness our club has very determined individuals who will never let him or any of his cronies profiteer from our wonderful football club.
I don't want any of the individuals responsible for this to hang around, but I don't want them to slink away either. They need dealing with in a way that keeps them out of football for life, and maybe even criminal charges (should anything be proven).
Otherwise, they will find that Dale fans will share legitimate evidence on them every time they slink from club to club,

It's completely legal.
The massive problem is for Southall that the "Another" in Optimus Build Ltd v. Matthew Southall & Another is Jade McManus.
There had also been a pleaded issue as to whether or not the second defendant, Ms McManus, was party to the contract, but sensibly given the evidence, that defence was not pursued at trial
So Optimus Build are actively pursuing both Matthew Southall and Jade McManus.
Rochdale fans have nothing against Ms McManus, she wasn't seen at the club in April 2021 for a meeting with Curran and Jarvis.
But her choice of men leaves a lot to be desired.
The house might be in her name, but its possibly the only pursuable asset for Optimus to get their money (and they have a charging order on it) and equally she and Matthew might be moving soon.....
Charlton fans are watching and waiting.

Only the parties concerned will know if Southall and McManus paid the amounts awarded by the relevant court on time.
You'd expect that based on what is known of the financial situation re: 264 Leigh Road, Worsley then not paid but it is checkable at the Land Registry as when the money is paid the Land Registry, Optimus Build will be told to remove their charge.
The only way it looks that significant sums get repaid is if the house (valued at £900,000 on the land registry) gets sold and those with charges on the house receive their funds with any surplus given to Jade McManus (the legal owner).
God knows what happens if there is still a financial deficit after sale and repayment of priority creditors.
I'd presume that bankruptcy proceedings would have to be the only thing possible to end the case. That would finish Southall and McManus personally and also mean that the builder would not receive their money.
The reputational impacts of a bankruptcy order stop anyone concerned interfering with football clubs. I can't imagine that they are good for an Instagram following either.
It looks a parlous personal financial position that's for sure.

The Charlton Southall/Nimer deal apparently falls over when Southall, having paid £1, fails to convince Nimer to put in £10m; the initial £5m in January 2020 and £5m in Summer 2020.
Southall then tries to line up some other investors or a "consortium" as he puts it in the video and at the end invites Nimer to sell him the club for the £1 that he paid for it.
I'm not Simon Jordan's biggest fan but he tears Southall apart here.
And look at the smirks of Jim White.
The relevance to Optimus Build?
At 4.34 in the video, Matthew Southall notes that he owns 35% of the shares "in a personal capacity"
So when Charlton Athletic was sold to Thomas Saandgard in September 2020, Southall got 35% of the pie.
We owe Charlton fans a lot, but not as much as is owed against 264 Leigh Road in Worsley.

Jade Katy & Jade Katy Home have both gone very quiet on Instagram since Christmas. No photos of new nursery furniture, designer shoes or extravagant lunches with smooth-skinned, sun-kissed girlfriends I'm sorry to say.
I do hope that there haven't been any problems with credit cards in Selfridges or in those exclusive Champagne Bars.

From what the Land Registry following the Optimus Build Ltd v. Matthew Southall & Another and the charges on the property, their charge can only be removed by a solicitor with the consent of the person who benefits from the charge.
Section 2.4 of this guide looks the most relevant:
"If applications are made to simultaneously discharge a registered charge and register other dispositions and there is a restriction in the register in favour of the existing lender which prevents registration of those dispositions, we will requisition for either evidence of discharge of the relevant charge or evidence that the terms of the restriction have been met. If the requisition is not complied with, we will cancel under rule 16(2) of the Land Registration Rules 2003 not only the application for discharge but also the applications to register any dispositions caught by the restriction. For instance if applications are made to discharge a registered charge and register a transfer and charge we will cancel the applications to register the transfer and charge as well as the application to discharge the charge. If however the restriction only prevents the registration of a charge, we will complete the registration of the transfer but cancel the application to register the new charge."
That looks to be the piece of law that means that if the house is sold, Optimus Build get every penny that they are owed out of the property.

Maybe she's lost some of her influence? Allegedly? Without prejudice.

Then a lawyer to say that the planning permission is valid and properly enacted.
Then a surveyor to say what has been built has been build to the scope of the planning permission and of sufficient quality.
Then a mortgage company to come and say that all of the above stacks up, assuming the buyers is buying with a mortgage.

Despite a supposedly buoyant property market the 264 Leigh Road property in Worsley property is STILL unsold.
What can the problem be?
Perhaps a spanner has been put in the works by a raft of Dale fans calling Briscombe asking to view Matt and Jade's pad?
Perhaps the decor of the interior designer isn't up to the tastes of proper buyers.
Perhaps its massively overpriced?

Briscombe are telling interested buyers that there "is a problem in the chain" and are inviting counter offers for proof of funds.
If you can do that then they'll let you view it.
But interest rates are rising, banks are looking more and more at affordability and toughening up lending criteria. The number of interested buyers is dwindling all of the time.
