First, this was not an action with immediate and tangible consequences, as might have occurred had this woman shouted something similar in the crowd outside an hotel under attack. Second the "for all I care" phrase slightly dilutes the force of the apparent incitement to violence. In the USA the courts use a "clear and present danger test". This means that: "The question in every case is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent. It is fine to disagree. My comment rests on the argument that there is a difference between the following two statements. Kill those F....... B........s. You can kill those F_______ B_____s for all I care. Although both are worthy of censure, I believe there to be a difference in the strength of the incitements. As to whether "it only needed one person", there are the issues of immediacy and proximity that I mentioned. I did not follow this 41 year old woman's tweets on X and doubt that persons on their way to the riots were reading them. As the OP suggests, a punishment might well be appropriate after due process, but to my mind a 3 years sentence is OTT. I notice that some of our US cousins are saying this would not have been an offence in their jurisdiction. [Post edited 2 Sep 17:02]

Too many people are posting things that are just not acceptable and serious harm can be caused, children have committed suicide through online abuse.
