Got a lot of sympathy for this viewpoint, but I'm not entirely sure that the current judicial system is in any way prepared or able to deal with social media. On the face of it a custodial sentence like this for posting some racist nonsense on Twitter is ludicrous when you consider that Huw Edwards walked free for Paedophilia, which gives you some idea of how poorly things are aligned. There needs to be a lot more flexibility within sentencing guidelines, and judges prepared to work within that and use common sense. [Post edited 17 Oct 21:05]

One way to look at this is that prompt, tough action had the desired effect and a line has been drawn under recent civil disturbances. Others will say (or think in private) that the line between what people can say or not say has moved, that this is increasingly different from the way the line is drawn in some other countries such as the United States, that there are issues about relativities in sentencing and a selective focus with a political aspect, and that this adds a new dimension to the culture wars. We'll have to wait and see who is right, but I would not be surprised if there are unintended consequences. | | | |
