How did those shares get sold without the EFL giving their permission.

The EFL have evidence that the club (via its Board or employees) were in breach. I suspect this was driven by actions ahead of the proposed acquisition. Time will tell as we don't have access to the information held by the EFL. Our new Board will know and they can't tell us. I am sure the club's lawyers are pursing individuals that led to this fiasco as they had a duty of care for the club and the integrity of the EFL rules the club needed to follow.

Completely right Sandyman. The only month that matters is July 2021 which is when the EFL are saying the deed was done.

The other thing that hasn't been floated yet, but should be is a potential class action by non-Morton House shareholders against those individuals who created such a situation.

The media has published some quite conclusive evidence that minor shareholders were possibly deliberately prejudiced by the events in July 2021. The EFL will, in time, have to publish their decision(s) which will be a matter of public record.

Note, this is before anything that happened in October 2021 and subsequent.

Imagine if little individual shareholders at July 2021 all joined together and took those the EFL deem responsible for July 2021's events to court?

Do the EFL think the club should have said to Morton House. Submit transfer forms in the names of Faicial, Darryl, Andrew and Valarie for approx 10% each rather than in the company name for 42%. That way as a collective you have a 42% share but wouldn't be subject to the OADT. Should Simon and Co have done more to help facilitate this hostile take over? Is that the message the EFL are sending out by charging the club

The Board is not in support of this action, but is seeking to create a share issue soon to qualifying individuals to raise funds.

More details will follow on this initiative, which will be put to shareholders at an Extraordinary General Meeting.


What I think that demonstrates is:

(1) In June 2021, before any share transfers the Board were "not in support" of the actions being undertaken

Both of those statements coming well before what the EFL statement has confirmed today were JULY share transfers.

I think that a precedent has been set with the EFL charging Swindon Town over events that occured during a previous ownership , any sanctions we receive I think would be suspended.

"Upon consideration the Board determined that it would be appropriate to do so in these circumstances and offered the Club the following sanction, which was subsequently agreed:

- A suspended three points deduction to be immediately activated in the event that the Club breaches Regulation 63.7 on or before 30 June 2022.

An EFL Spokesperson said: “Whilst this decision relates to a period when the Club was under different ownership, the EFL has a responsibility to treat all cases of misconduct equally and has taken the appropriate course of action in line with its Regulations. "
