MORTON HOUSE / EFL conclude investigation charging "multiple individuals&am on 13:56 - Mar 16 with 4065 views | RAFCBLUE | No - the charges from the EFL today against the club and a number of individuals are all about how shares were transferred contrary to EFL rules in July 2021. How did those shares get sold without the EFL giving their permission. It has nothing to do with any event after July 2021, regardless to how others might want to spin it.

Precisely. The wording says: "Following the conclusion of an investigation into the acquisition of shares in Rochdale AFC by Morton House, the EFL has charged the Club and a number of other individuals with alleged breaches of EFL Regulations. The EFL has been considering whether the Club, any Official, any Relevant Person(s) and/or any other Persons involved complied with the requirements of the Regulations in respect of the acquisition of shares in the Club in July 2021. Having comprehensively reviewed the relevant issues, the EFL has now determined there is sufficient evidence to justify issuing various charges of Misconduct.

The EFL have evidence that the club (via its Board or employees) were in breach. I suspect this was driven by actions ahead of the proposed acquisition. Time will tell as we don't have access to the information held by the EFL. Our new Board will know and they can't tell us. I am sure the club's lawyers are pursing individuals that led to this fiasco as they had a duty of care for the club and the integrity of the EFL rules the club needed to follow.

Completely right Sandyman. The only month that matters is July 2021 which is when the EFL are saying the deed was done. The other thing that hasn't been floated yet, but should be is a potential class action by non-Morton House shareholders against those individuals who created such a situation. The media has published some quite conclusive evidence that minor shareholders were possibly deliberately prejudiced by the events in July 2021. The EFL will, in time, have to publish their decision(s) which will be a matter of public record. Note, this is before anything that happened in October 2021 and subsequent. Imagine if little individual shareholders at July 2021 all joined together and took those the EFL deem responsible for July 2021's events to court? The People vs Roger. Would be like the 1st June all over again.

But the sale of the infamous five's shareholdings was done behind the backs of the current board and as far as I am aware the transfer forms haven't been submitted to the club/efl/companies house. Do the EFL think the club should have said to Morton House. Submit transfer forms in the names of Faicial, Darryl, Andrew and Valarie for approx 10% each rather than in the company name for 42%. That way as a collective you have a 42% share but wouldn't be subject to the OADT. Should Simon and Co have done more to help facilitate this hostile take over? Is that the message the EFL are sending out by charging the club

I believe the share sales went ahead without the knowledge of the board at that time. I think the new board would not authorize the transfer because the correct EFL procedure had not been followed. Whoever advised these buyers is nothing short of a fookwit.* *no, it wasn’t me

https://www.rochdaleafc.co.uk/news/2021/june/statement_boardofdirectors/ At the time, judd, on 30th June 2021, the Board of Directors said: We are aware of a group or individuals who are currently attempting to buy shares from shareholders with a takeover in mind. The Board is not in support of this action, but is seeking to create a share issue soon to qualifying individuals to raise funds. More details will follow on this initiative, which will be put to shareholders at an Extraordinary General Meeting. What I think that demonstrates is: (1) In June 2021, before any share transfers the Board were "not in support" of the actions being undertaken (2) In June 2021, before any share transfers the Board had announced that an EGM would be held to "to raise funds" Both of those statements coming well before what the EFL statement has confirmed today were JULY share transfers. You can only imagine that any daft brush buyer completed having seen that statement which has had over 5,400 views!

It's also worth noting that Captain Sabotage is completely to blame. https://www.telegraph.co.uk/football/2021/08/05/efl-investigating-homophobic-slu The call nevertheless prompted a WhatsApp message from Alexander Jarvis, who described himself as an adviser to what he admitted was a “hostile takeover” and said that Curran was “a bit of a recluse”. https://www.manchestereveningnews.co.uk/news/greater-manchester-news/businessman Mr Curran has not commented on the claims specifically, but Mr Jarvis has now sought to clarify what his client said. Mr Jarvis said: "My client said 'several board members were small-minded and wanted managed decline instead of returning to League One'. Those articles were 5th August 2021 and 12th August 2021 respectively AFTER what the EFL have now confirmed are share sales in July. Jarvo botched it. He's managed to implicate a whole raft of individuals: Andrew Curran - who Fat Pat saw at Spotland in April 2021 Matthew Southall - who Fat Pat saw at Spotland in April 2021 David Bottomley - who Fat Pat saw with Jarvo in April 2021 Darrell Rose He's got to have implicated them all since the Board in June 2021 (before these shares were sold have said) https://www.rochdaleafc.co.uk/news/2021/june/statement_boardofdirectors/ We are aware of a group or individuals who are currently attempting to buy shares from shareholders with a takeover in mind. The Board is not in support of this action, but is seeking to create a share issue soon to qualifying individuals to raise funds. Can't be any clearer. Board not in support of Andrew Curran Board not in support of Captain Sabotage Board not in support of Matthew Southall Board not in support of Darrell Rose Board not in support any takeover. I don't think it is any more difficult that this. Question for Jarvo - will you grass formally to the EFL to save your skin? I wouldn't put it past him; there is no one going to take him seriously for a football deal ever again after this.

MORTON HOUSE / EFL conclude investigation charging "multiple individuals&am on 09:56 - Mar 17 with 2302 views | lyberoc | I think that a precedent has been set with the EFL charging Swindon Town over events that occured during a previous ownership , any sanctions we receive I think would be suspended. "Upon consideration the Board determined that it would be appropriate to do so in these circumstances and offered the Club the following sanction, which was subsequently agreed: - A suspended three points deduction to be immediately activated in the event that the Club breaches Regulation 63.7 on or before 30 June 2022. An EFL Spokesperson said: “Whilst this decision relates to a period when the Club was under different ownership, the EFL has a responsibility to treat all cases of misconduct equally and has taken the appropriate course of action in line with its Regulations. "63.7 The terms of a Standard Contract between a Club and a Player shall be strictly adhered to. Guidance In line with decisions of the PFNCC the EFL cannot accept termination / break clauses in Contracts, except in cases where the PFA, on behalf of the player, agree. The only situations where agreement has been given have related to known serious medical conditions which pose the risk of having to cease playing e.g. heart conditions. Similarly, the EFL cannot accept contracts which seek to contradict or remove any of the provisions of the Standard Contract unless (a) they relate to clause 4 — image rights, provided equivalent provisions are contained within the image rights agreement; or (b) excluding clause 19 (severance pay) in a multiplicity contract (see Regulation 62.5).
