I'd be more concerned about what information and evidence the Club can provide to the Disciplinary Commission and from then what sanctions they impose shall we ;0)

Lets hear the evidence. Lets save the Club. If the EFL were to charge individuals and not the club, the individuals could say 'its not fair, we were invited by the club'. By also charging the club, it allows the 'independent commission' to review all of the available evidence from all parties, and to decide exactly who is guilty. Every Email, every phone call, every letter, every piece of evidence that will have been forensically pulled from files, devices, records will now be openly viewed and discussed. Every dirty little secret from every individual involved will now become public interest. The wrong'uns have clearly seen this as an opportunity to try and sow discord amongst the fanbase (multiple trolling attempts on every single platform)... by trying to divide the fanbase they are trying to make the club weaker ahead of all of these legal fights. If the individuals were so sure of their case, so confident they had done nothing wrong, and so adamant that they would win and take control of the club, why would they feel the need to resort to underhand tactics at this moment in time? This is a chance for the EFL independent commission to cast off the shadows of Bury, Macclesfield and many others before it... a chance to show its teeth, and prove that it is here for the good of clubs and football in the long term in the UK. As the ownership of MH changes on a regular basis, perhaps the EFL chose to target "multiple individuals" (and hopefully ban them for eternity) as a better way to cut the head off the snake? I don't suppose Faisal/Faical wants to be involved with a northern L2 club on his tod? He's got Argos orders to get out on time.

The EFL seem to think they are which is why the Club have been Charged. It will be hard to fundraise to assist in fighting this charge given the charges have been brought by the EFL. |
You really are pretty thick aren't you The charges relate to the acquisition of shares during the attempted (failed) hostile takeover, past tense So yes, i'm sure the Club aren't in the wrong, present tense How's your bank balance looking? Up for losing even more money you never had in the first place? How's your family holding up? Are you sure they're not looking at you as a complete tosser they wish they'd never got involved with?

It's an interesting point on the £1m into the abyss. Ladies and Gentlemen I remind you of this, from the Manchester Evening News on 12th August 2021, shortly before the EFL launched their disciplinary investigation. https://www.manchestereveningnews.co.uk/news/greater-manchester-news/businessman Responding, Mr Curran's statement said the MP had either been 'misinformed' or 'not made aware' of the current financial position of Rochdale AFC. He went on: "The club is certainly not a 'cash cow, far from it. It's got no money and without significant investment, the club will run out of money before the end of the year. "The board has already confirmed it has no intention or means of putting in the funds required to sustain the club for the foreseeable future. (These include) a substantial outstanding loan (which) is secured against the stadium; HMRC payments are in arrears, and players have been sold below market value. "We have made an offer to the current chairman to provide immediate funds to pay off these debts, increase the playing budget and buy players for the best possible opportunity of achieving promotion back to League One this season. "We estimate this to be a requirement of around £500,000 immediately, with a further £500,000 in January. This offer has not been accepted. All lies of course, given that we are now in March 2022 and still here. The problem with Jarvis was - and is - that he's implicated Andrew Curran. This Manchester Evening News article coming a week after Captain Sabotage had outed Andrew Curren to the Daily Telegraph: https://www.telegraph.co.uk/football/2021/08/05/efl-investigating-homophobic-slu The call nevertheless prompted a WhatsApp message from Alexander Jarvis, who described himself as an adviser to what he admitted was a “hostile takeover” and said that Curran was “a bit of a recluse”. I really hope that two of the individuals charged by the EFL are Andrew Curran and Alexander Jarvis. Particularly funny that Jarvis will have provided most of the evidence against himself and Curran via his utterances in the national press. Then today the EFL: https://www.efl.com/news/2022/march/efl-statement-rochdale-afc/ The EFL has been considering whether the Club, any Official, any Relevant Person(s) and/or any other Persons involved complied with the requirements of the Regulations in respect of the acquisition of shares in the Club in July 2021. Having comprehensively reviewed the relevant issues, the EFL has now determined there is sufficient evidence to justify issuing various charges of Misconduct. This is the EFL saying the deal was done in July 2021. Why Captain Sabotage was outing Curran in August 2021 to both the Daily Telegraph and the Manchester Evening News is anyone's guess.

Well said, at the moment we can only speculate until the EFL puts its cards on the table. We know enough about what has happened to recognise that there were people within the club who intended to benefit personally to the detriment of the club and to the detriment of its employees and other shareholders, rats who thought they were sneaking away from a sinking ship. It is also apparent that Covid rules were used to try and cover their lack of due diligence in assessing potential investors. Even to the unneccessary and probably illegal attempted restrictions on entrance to an AGM by "smaller" shareholders The forensic examination of employee's computers may well bring the depth of the conspiracy to light and I have no doubt the EFL will take all this into account. Ultimately, the Directors accept responsibility for a legal entity owned by a multitude of shareholders. That legal entity has been betrayed by a cabal of previous directors and those responsible have been removed from office once the betrayal became public. They had no remit to seek other investment or to aid and abet the purchase and sale of shares between private individuals in contravention of EFL regulations. That they were removed from the Club at the earliest opportunity must surely be recognised by the EFL. Amidst all this, questions still exist as to the precise ownership of a large tranche of the Club's shares. There are known unknowns and many unknown unknowns I suspect.

MORTON HOUSE / EFL conclude investigation charging "multiple individuals&am on 11:29 - Mar 16 by HullDale | If somebody (lets call them Bavid Dottomley) is driving a car, and chooses to write off the car in a crash to make some insurance money, is the car at fault? Or, as part of the investigation into Bavid, would the authorities undertake a forensic examination of the car as part of the charges against Bavid for dangerous driving? Probably. Would the car be found guilty after investigation? No. Could there be recommendations about the brakes? Or the dealership checking the credentials of Bavid before purchasing? Possibly. Look at EVERY club who has been found guilty by the EFL historically... they have all benefitted in some way, even in the short term, from investment / league position etc. This has caused Rochdale nothing but pain and problems. What if it was a company car? The problem is we were being ran by wrong-uns hopefully they will get what's coming to them but unfortunately for a period of time those wrong-uns by default were the club. We were also trying to be taken over by arguably worse wrong-uns. All wrong-uns broke rules and should be punished. The true club however fans and community have shone through and taken back control of the club. Hopefully when it comes to any punishment this is taken into account. (I won't hold my breath)

Fiduciary duties and responsibilities of Company Directors... "Most fiduciary duties have now been set out under company legislation. However, the common law duties still exist in a slightly different form. They establish trust and confidence, bringing in the wider principles of no conflict and no profit. The main fiduciary duties are:- to act within the powers conferred by the company’s Memorandum and Articles of Association; to avoid a conflict of interest; to act in the best interests of the company; not to fetter one’s own discretion; and not to make unauthorised profit." https://www.franciswilksandjones.co.uk/directors-fiduciary-duties/

Not read all posts so apologies in advance… from that statement I assumed that the charge was regarding the club selling more shares to dilute those of Morton house, is that not the case then?
