OK, here’s the answer. Firstly, and more well known is that if you use your home for business activity, then the portion of the house used can attract tax relief but on sale will be subject to CGT. Secondly, and not a lot of people know this, if your house has more than 0.5 Ha of land then you may be forced to pay CGT . You’d have to prove that the extra amount of land is ‘enjoyed by the property’ in other words it would be necessary in the sale of the property. This is one of the most random taxes I know of. Why 0.5 Ha? Why get penalised for having a large garden. It is incumbent on the homeowner to declare this of course but how many would know. When I sold my house, I had no idea of the tax. My accountant didn’t either but it was picked up rather unfortunately by HMRC who I then had to fight by engaging a specialist lawyer and coming up with everything I could.
