But what does "based on the law" mean? It is not as though the law comprises an unchanging set of rules which can be applied to myriad situations without interpretation. Rather we are talking about an accumulated corpus of case law in which the meaning of domestic and international law shifts over time (see the article by Jonathan Sumption in the Spectator that I mentioned recently). In this Court of Rome case the understanding of what a safe country is had been modified by a recent Court of Justice of the European Union (CJEU) judgement that said that it is not enough for a country to be generally safe for it to be suitable to receive immigration returns. The country must be safe in all its regions, and in multiple aspects. https://eulawanalysis.blogspot.com/2024/10/safe-countries-of-origin-in-asylum-la The effect of this, if not overturned, is that a very large number of countries in Africa, South America, Asia and the Middle East will not be considered safe. If nationals from these countries can get to an EU country the courts will prevent them from being deported, even if their asylum claim is denied. In other words, EU law commits countries in the region to take in a huge proportion of the global population (numbers far beyond what they could accommodate) if they turn up on European shores.
