Bunch of crooks. Do not ever use them, they've just charged me £350 for an imaginary scratch on the car I hired at Luton airport, and they are not responding to any of my emails.

Does anybody know of any procedure I can follow to get my money back?

Yes I gave a credit card, it's always like that when renting cars.

I dropped the car at the holiday Inn car park, as they had always instructed me to do. I checked the car was fine, but obviously didnt sign something with them, because they werent there.

They charged me for the holiday inn car park (they didnt tell me they changed the return policy) and then charged me for a scratch. I have requested a picture of it, complained that they didnt tell me about the change of return place etc... They are ignoring all my mails.

It looks like I am well and truly shafted, and wonder if there is something I can do.

There are lots of trip advisor forum entries from people having similar bad experiences to mine with them. I used them a lot before never had problems, until this last weekend

I rented two cars from a company called Firefly in Spain this summer. It's owned by Hertz, and it is as if they have tried to set up the Ryanair of car rental. Terrible customer service, hidden charges on insurance and refuelling, knackered old bangers - my "VW Golf or similar" turned out to be a Kia with 120,000 km on the clock - and an arbitrary £60 quid lobbed on at the end for unspecified wear and tear. Total bandits, avoid like the plague.

A Eurocar franchise in Qatar tried to do the same to me. They blamed me for scratches underneath the car, even though there was no way to inspect under the car and no evidence was given. I contacted American Express who put a freeze on the payment. I also asked the rental company to give me 3 quotes from reputable garages where the so called damage was going to be fixed.

A lot of these companies think that because you've agreed to a £350 excess they can just take that amount for any small amount of damage. You can get dents and scratches removed for next to nothing, so ask them where they are getting it fixed and how much it's costing. Most of the time they don't get them fixed, so they can't charge you the excess.

Paying by Credit Card should mean you aren't shafted as you can do a charge back via the credit card company. This means you dispute an unfair or fraudulent payment on your card and the card company will put the onus on the rental company to prove that the charge is justified. Definitely your best option as the rental company can't ignore the payment provider.

A tip for anybody who hires cars on a regular basis, buy an annual cover through this company:

£39.99 per annum, covers all of the excesses and also is far cheaper than the car rental will offer you per day for excess insurance. They don't like it and will put a charge still on your credit card but if there is a dispute then insurance4carhire are the ones that get involved and you recover your costs. In Spain during the summer, was getting my car from one of the more 'reputable' firms Goldcar and whilst I was getting my keys some poor bastard next to me was being flogged the excess insurance by being told it is the 'comprehensive' part of the policy and what he is covered for was just third party, fire and theft. I leaned across and told him it was total bollox and then gave the rep a volley for her completely misleading the guy. Don't trust any of them, check your car before leaving thoroughly pointing out to the rep any damage, however minor and get them to sign the acknowledgement and where indicating on the car map where the damage is and then when giving the thing back, make sure there is someone to give it the once over and again sign for it. The only company that I have ever dealt with that I decent is SixT. They are pricey, but you get excellent, clean vehicles and what you pay is what you are quoted, no hidden extras and they operate a full to full policy on the fuel.

Did you pay by Credit Card or Debit Card? Tell your bank it was an unauthorised payment which you didn't sign for and had no knowledge of.

I've used Hertz with pick up and drop off at Heathrow and never had any problems. Very professional outfit as you'd expect and that's what you're paying for. A proper pre and post inspection of the car signed by both parties will always ensure there are no nasty surprises afterwards.

Good point, that annual cover is worth having.

You mention Goldcar: Their Lanzarote outfit tried to stitch us up with a mysterious extra charge for about £60. It was fairly easy for us to prove that they had made a mistake based on times and dates but it was devious all the same.

I haven't used a car rental for ages (maybe 5 years or so). I used to use easycar because they had a garage in Edgware Road. My impression was that they over time they were less fussy about small scratches, perhaps realising that these were a fact of life. The rental itself seemed to get more and more expensive, so perhaps they weren't looking to make money out of scratches.

Once the credit card company has recovered the funds I suggest you contact them again to request a replacement credit card with a new number. This will prevent some smart alec at Green Card trying to rerun the transaction. The easiest way is to tell them you've lost your card and want a new number for security reasons.

I think debit cards are all processed either through the Visa or MasterCard networks now as Maestro has been knocked on the head as a brand.

I queried a similar thing with my bank a few months back as I had paid for it with a First Direct Visa Debit card and they confirmed that I would have had the right to ask them to charge back the company if I deemed it had got to that stage where nothing else I could do would make the company I was in dispute with see sense.

Check with the bank.

Great advice.

Same happened to me years with a car hire company and I got all my money back from my bank who issued my card. My argument was simple - "if a man walked in through the doors of your bank and said 'give me 1,000 of Brian McCarthy's money', would you give it him? No. Because that would be irresponsible wouldn't it. Ok, gimme my money back"

Took six months, but I got it back. With interest.

I think it has to be a credit card rather than a debit card.

There is a particular piece of legislation which applies to 'credit', if you are using a debit card there is (obviously) no credit agreement, therefore this legislation does not apply.

I'll see if I can find a link to the legislation, there's probably something about this on 'Which'.

Would be happy to be proved wrong though.

If the bank issued the credit card then contact the credit card department (as opposed to asking someone in your branch to sort it out). The telephone number should be on the back of the credit card or on their website.

Tell them that you are registering an illegal transaction and want to issue a chargeback. They are legally bound to fulfill your request.

I also had a hard time getting the same company to return my deposit. When I initially returned the car they tried to suggest a scuff was there, which I immediately refuted and they agreed. But even when they weren't even alleging any damage they were very slow, claiming for a long time that their PDQ machine was broken and that the relevant manager was not in the office to authorise my deposit to be returned.

Persistence paid off in my case, and I didn't need to take it further. I just hounded them with calls, being firm but polite and reminding them that they couldn't hope to obtain any repeat business if they treated customers that way, until they finally returned the money. Took about 4-5 weeks from memory.

It's such a shame as I'd much rather use a local company than some faceless corporation. Good luck - stick to your guns and I'm sure you will win out.

Given the way we checked the car when I picked it up, we would definitively not have seen it anyway, so it does look like a scam. Grrrrr
