Gross misconduct is rarely clearly defined and the burden of proof lays with the employer to identify how the employee has broken the contractual relationship. QPR need to prove that the decision to dismiss Barton was one that a reasonable employer would have made, was fair and reasonable in the circumstances, and that the offence was so wrong that dismissal was an appropriate sanction. Since clubs almost never terminate a player's contract after a FA hearing following an on field incident (Cantona, Suarez, etc), precedent is in Barton's favour. | |
