A joke or a serious offence!?
Would that be allowed in the work place or in public? If not, why should it be acceptable as a joke on a professional playing field.

No, it’s not Sexual Assault.
It’s covered by s3 Sexual Offences Act 2003. In order to be guilty, it has to be shown that : -
(a)he intentionally touches another person (B),
(b)the touching is sexual,
(c)B does not consent to the touching, and
(d)A does not reasonably believe that B consents.
Now, a,c and d is made out. Issue is with b. It would have to be shown that Manler’s intention behind the grab was sexual, as opposed, to eg wind him up, which, i think was the case.
He’s a dick and deserved a slap, but it’s never sexual assault.

First of all, any comment I put on here regarding legal issues are not my personal opinion neither am I saying what is deemed to be ‘ok’ or acceptable, I am only explaining what the law is, that is my job, any case I deal with, I never judge whether I believe someone is guilty or not, that is the role of the jury.
To deal with your specific question, touching someone without their consent in the way that you mention would definitely be an assault. As far as the law is concerned (and if you have a problem with this, take it up with the legislature not me) it will come down to the context and intent of the perpetrator.
There is a world of difference between being in a night club and grabbing a woman’s breast and doing what Mahler did in the aftermath of a fight. It would be quite difficult to persuade a jury that grabbing a woman’s breasts would be anything other than sexual other than maybe in the middle of a fight eg. You could quite legitimately suggest then that the intention was to inflict pain as opposed to further a sexual intention.
It an important difference but consequences of conviction for a common assault as opposed to sexual is massive including eg, Sexual Offenders Register and devastation for future job prospects. |  | | |
