He claimed that the Immigration Act 2014 did not remove the protection against deportation available to Windrush migrants... and in his own words... "No such protections have been removed. People who arrived pre-1973 - they have the absolute right to be here and that has not changed." Yet.. The clause giving longstanding Commonwealth residents protection from enforced removal, was taken off the statute book by the 2014 Immigration Act!! So is he telling porkies, or has he caught the Home Office disease?? "That they wouldn't know the truth if it smacked them in the face" [Post edited 1 May 2018 19:06]

According to your logic the 2014 Act removed these people's right to remain, but that is incorrect. Presumably Javid was simply making the point that under the provisions of the Immigration Act 1971 people from Commonwealth countries (and their wives and children) who settled in the UK before 1973 can remain in the UK indefinitely. The significance of the 2014 Act is that it required people to provide proof of residence as a condition of access to certain services or to stay indefinitely, and many of the Windrush generation found it difficult to produce documents showing they arrived before 1973 (when the tougher 1971 Act came into effect). So Javid was correct to say that pre-1973 arrivals always had a right to stay, because Section 1 of the 1971 Act is still in effect. The issue is that the Home Office should have been more understanding in helping them establish when their residence in the UK began. | | | |

Well not to support May or the tories but, how can Labour just take over? WE'd have to have a general election and Labour would have to win. The way things are currently it's hard to see Labour or Tory doing anything but worse in a GE. They are both in mires pretty much of their own making. Then there's the Libdems, does anyone thibk they'd be better even if they could win enough seats? Maybe we should have a GE to find out but all I can see happening is another minority government, another weak government which (whoever it was) would struggle to get anything worthwhile through Parliament. Part of me hopes for a Corbyn win now, I believe he would be even more ruinous for this country, if that's possible. With all the borrowing he plans I think in a few years we'd be seeing massive inflation, interest rates causing mortgage defaults to skyrocket again but hey, maybe some of the rich would actually be in the same boat as us poor, lazy, welfare scroungers and we could laugh at them. Truth be told May has little support from anywhere in her ranks but Corbyn has Momentum and they will never accept anything bad about St Jeremy to be true. | |
