Go and have a look at the video and his obvious attempt at sidestepping a breath test; unfortunately he was both too thick and too pi55ed to understand the consequences. Then there was his arrogant approach to the court hearing. | |

Police do not have to give repeated warnings as to failing to provide,often by sucking or blowing through side on mouthpiece but to save solicitor using this ruse ,some custody officers almost beg the punter to blow. Harsh is when someone who has the opportunity to kill people on public roads is allowed to walk free. Drink driving is possible butchery but I admit to a little bias as having to free body parts from a car isnt pleasantIt kinda smells and it stays with you for life. Done it too many times so forgive my indignation. Saunders has a few bob and does not need to drive himself.It is arrogant,self indulgence and possibly lethal. ST.Sometimes Police have to do nasty things to protect you and family. Next ....why not confiscate cars of drunk drivers and sell them into public funds. Drink driving kills .You drink ,dont drive, and dont complain when getting caught and sentenced. I note this cretin refused roadside and station tests. Why? Cos he is feckn legless and any innocent family coming bck from a weekend away with the kids in north Wales could have been wiped out b this tw@t. The main focus that a lot of the drink drive specialists rely on is whether or not the ‘statutory warning ‘ has been given. What this means is that when you are about to blow into the machine, the police have to warn you that you will be asked to provide to samples of breath and failure to do so may result in being prosecuted. If that’s not given, the case collapses there. People also use medical defences such as asthma, panic attacks etc, however, these are very difficult to prove as the defence has to show that they could bot provide due to this, which has to be via medical evidence, normally being a doctor giving evidence in court. Police, if they believe the defendant is genuine, can offer blood or urine as an alternative. Re the Freeman point, I do agree with Perch, however, his wings have been clipped recently with changes to the way these cases are run. I have given training sessions to police officers about the procedure and have used Freeman’s previous cases as part of the lectures. Rather than castigate him, use him as training to know what not to do next time. In answer to the question about whether the Judge can increase the sentence, absolutely he can, probably won’t here but is certainly within his power. As part of the sentence, the judge will look at two things. 1. If there was any indication of serious impairment, and 2 was there a deliberate refusal. I know nothing about this case but seeing the sentence the judge must have decided both applied. The appeal, on the guidelines is perfectly reasonable as they’ll be arguing that the sentence should have been suspended, not immediate. Seeing how near the appeal is, they’re probably appealing the sentence as opposed to the conviction. | | | |

I know of the consequences of drink driving. I prosecuted, last year, a death by dangerous driving of a young boy who was killed by a drunk driver. I read about and saw the pictures of the dead body, I spent over a week on the trial, I spoke to and consoled the family after the trial, I had to guide his mother through giving evidence about the day, I ripped the defendant apart during cross cross examination and dismantled his lies one by one, I had the responsibility of obtaining justice for them. With the greatest of respect, please don’t, for the umpteenth time, question my integrity. You are not the only one that cares. I was asked for my legal opinion re the sentence for the offence, which is what I did. May I ask, how that is shocking ? | | | |
