Governments in more than one European country have discussed the possibility of off-shore processing of illegal migrants, but this appears to have been dealt a huge blow by the immigration division of the Court of Rome, which has instructed the Italian government to bring the migrants recently transferred to Albania back to Italy.

The court said that the transfers were unlawful because the origin countries of the migrants concerned, Egypt and Bangladesh, were not safe countries. Critics have pointed out that according to the criteria the court used to judge a country safe, the only African country on the list would be Cape Verde.

Is off-shore processing now a non-starter? Even Starmer had seemed to be coming around with the rumour about deporting illegal migrants arriving in the Chagos Islands to St Helena.

The judge actions is based on the law. Clearly for any sort of solution the law needs to be changed.

With regard to UK bound boat people the authorities in UK and France are not doing enough.

My benchmark for this comment is the fact that there was massive fows of boat people from TC back in 2013 or so. Once TC cut a deal this was cut to zero by effective policing with force.

The judge actions is based on the law. Clearly for any sort of solution the law needs to be changed.

But what does "based on the law" mean? It is not as though the law comprises an unchanging set of rules which can be applied to myriad situations without interpretation. Rather we are talking about an accumulated corpus of case law in which the meaning of domestic and international law shifts over time (see the article by Jonathan Sumption in the Spectator that I mentioned recently). In this Court of Rome case the understanding of what a safe country is had been modified by a recent Court of Justice of the European Union (CJEU) judgement that said that it is not enough for a country to be generally safe for it to be suitable to receive immigration returns. The country must be safe in all its regions, and in multiple aspects.

The effect of this, if not overturned, is that a very large number of countries in Africa, South America, Asia and the Middle East will not be considered safe. If nationals from these countries can get to an EU country the courts will prevent them from being deported, even if their asylum claim is denied. In other words, EU law commits countries in the region to take in a huge proportion of the global population (numbers far beyond what they could accommodate) if they turn up on European shores. It is rather like the scenario described in Jean Raspail's dystopian novel, The Camp of the Saints.
