MORTON HOUSE / EFL conclude investigation charging "multiple individuals&am on 10:02 - Mar 16 with 8202 views | RAFCBLUE | Following the conclusion of an investigation into the acquisition of shares in Rochdale AFC by Morton House, the EFL has charged the Club and a number of other individuals with alleged breaches of EFL Regulations. The EFL has been considering whether the Club, any Official, any Relevant Person(s) and/or any other Persons involved complied with the requirements of the Regulations in respect of the acquisition of shares in the Club in July 2021. Having comprehensively reviewed the relevant issues, the EFL has now determined there is sufficient evidence to justify issuing various charges of Misconduct. The multiple matters will now be referred to an Independent Disciplinary Commission and due to them being subject to ongoing proceedings, the EFL will not be making any further comment. That's Alexander Jarvis finished in football then.

I guessed this might happen. An inevitable consequence of having employees who decide to break rules, is that - ultimately - the company (club) are called to account. This happened in a case some years ago, involving Hasbro/Argos/ and other high street retailers. Where have I heard that before?

Were the RAFC shares ever officially 'acquired', or were they 'traded' between would-be purchasers as some kind of promissory notes? Again, the club has yet another fight to encounter and the sorry saga rumbles on. Oh!, how I hope the perpetrators have to face the music for this carnage. Comeuppance is needed and karma required by the bucket load.

It's not just the club charged, but "a number of other individuals", presumably more than two. The second paragraph of the statement is the most telling: The EFL has been considering whether the Club, any Official, any Relevant Person(s) and/or any other Persons involved So the EFL confirm they have charged the Club - inevitable really. But who are the individuals?

I think you've got to let the EFL process run its course. Just because someone is charged with something doesn't make them guilty and there reads to be a number of parties charged by the EFL. Presumably they cannot name the individuals just yet so that they, like the Club, get a fair trial. Also worth noting the EFL started an investigation in August 2021 and that has concluded in March 2022. The relevant rules are on their website and interestingly say: The intention behind this Appendix 3 is to protect the image and integrity of The League and its competitions, the well-being of the Clubs, and the interests of all of the stakeholders in those Clubs, by preventing anyone who is subject to a 'Disqualifying Condition' being involved in or influencing the management or administration of a Club. https://www.efl.com/-more/governance/efl-rules--regulations/efl-regulations/appe We are going to have to put our trust in the EFL that they run their process against that mandate. I'm sure they will; this hostile takeover is unprecedented. It's not in the EFL's interests to see hostile takeovers of EFL clubs without them signing off on the deal, which is the crux of the issue. Jarvis and others involved in Morton House thought the EFL were there just to rubber stamp what they wanted to happen last summer. In fact the EFL have done the complete opposite and stood up here and said they want to charge various parties and take them through their disciplinary proceedings. You could argue that had they taken this stance with what happened at Bury FC that they might still be in the EFL. [Post edited 16 Mar 2022 10:48]

MORTON HOUSE / EFL conclude investigation charging "multiple individuals&am on 10:55 - Mar 16 with 7690 views | D_Alien | A concern is how this is perceived by the rest of the football world, which can hardly be expected to understand the nuances in all of this. When the news breaks that " the club has been charged" many might conclude that Dale are in the wrong as we stand now, not as things stood under the old regime. And of course, the club can't comment It'll be important to use every channel to allay any misperception around this, especially at a time of ongoing fundraising to assist in fighting another "charge" should it reach a court [Post edited 16 Mar 2022 11:48]

How are you so sure the Club aren't in the wrong? The EFL seem to think they are which is why the Club have been Charged. It will be hard to fundraise to assist in fighting this charge given the charges have been brought by the EFL.

Surely in terms of the club being charged there are mitigating circumstances. The current board (& the trust) have done everything humanly possible to sort out this mess which was entirely down to the previous regime! I’m sure the EFL will take this into account before issuing any judgment.

Let's not dress this up to be anything other than what it is. An individual, with the support of another, whilst the Chairman looked the other way, acted in a way that he never should have and co-incidentally, is now the subject of legal proceedings by the club. You could make a case that governance was insufficient, but that will never happen again. I think there are going to be a lot of casualties at the end of all this who will hopefully be made examples of, but the club will go on in football no matter what punishment may eventually be meted out. Thanks for your insight and analysis though. Terrific. Truly.

If somebody (lets call them Bavid Dottomley) is driving a car, and chooses to write off the car in a crash to make some insurance money, is the car at fault? Or, as part of the investigation into Bavid, would the authorities undertake a forensic examination of the car as part of the charges against Bavid for dangerous driving? Probably. Would the car be found guilty after investigation? No. Could there be recommendations about the brakes? Or the dealership checking the credentials of Bavid before purchasing? Possibly. Look at EVERY club who has been found guilty by the EFL historically... they have all benefitted in some way, even in the short term, from investment / league position etc. This has caused Rochdale nothing but pain and problems. Ace. From you and your other usernames pretending to support the club you’ve now gone full circle and appear to be a bit rattled.
