It comes to something when the cps can’t deliver unused material to the defence that’s been disclosed to them. Nothing to do with the evidence though which was clearly adequate for a trial and potential prosecution.

This is becoming a recurring problem with the CPS.
The question is why? and what systems (if any) do they have in place to prevent it?

This is becoming a recurring problem with the CPS.

Because between 2010/11 and 2019/20 their budget was reduced from £831m to £567m or over 31%. - it had actually been a lot lower. Staff numbers were culled. Crime investigation and disclosure rules have become much more complicated and the amount of work generated has increased significantly. More recently the government have identified some of the issues and are/ have allocating more funding to the CPS to recruit additional staff (and also to the police). Previously the police would make decisions regarding prosecutions, but these days apart from very low level stuff decisions are made by the CPS and they have capacity issues.

Cases shouldn’t fail at Court, but our criminal justice system is creaking.
