Good spot. I normally only read news articles just the once but you must have been wanting to remind yourself of its content so went looking for it again. It’s good we have someone so diligent on the forum.

Perhaps the MEN, quite rightly, are not publishing anything on the case until it is heard in the courts?

The Trust said that they had "received an email from Matthew Southall with a statement from Morton House this afternoon that was being circulated to both local and national media. As you'd expect, we have passed this on to our legal team and we are not planning on making any comment at this moment in time.

We have received an email from Matthew Southall with a statement from Morton House this afternoon that was being circulated to both local and national media. As you'd expect, we have passed this on to our legal team and we are not planning on making any comment at this moment in time.

I'd expect that the Trust's legal team have contacted various parties to remind them of their responsibilities and that the MEN have sh*t the bed and taken it down.

But the MEN have left the following:

11th January 2022: Businessman who attempted 'hostile takeover' at Rochdale AFC banned from all football grounds
https://www.manchestereveningnews.co.uk/news/greater-manchester-news/businessman

25th September 2021:'We've lost one local rival, we don't want to lose another': The forgotten Manchester derby at risk of being lost forever
https://www.manchestereveningnews.co.uk/sport/football/football-news/rochdale-vs

23rd August 2021: Rochdale AFC chairman hails 'bright future' after takeover collapse
https://www.manchestereveningnews.co.uk/news/greater-manchester-news/rochdale-af

Quite right too - and you'd expect that the Trusts lawyers will have copies of everything ever published for the courts.

If you're willing to do that RAFCBLUE that would be a fantastic move and could save a significant amount of time and money from legal costs being charged at an estimated £4-500 per hour

It’s a sad state of affairs when you’re taking that as a victory, Matthew. LOL.

Have you seen the crowdfunding for the defence is going well? The funds to start are there and the great news is they’re going to keep on coming. It’s incredible how football fans pull together, isn’t it?

I’d say “see you in court” but your arse is going to fall out before that happens.

Kieran Maguire has risked the wrath of the Crayola kid with his tweet today noting that he is supporting a fan owned club.

That won't be taken down by Maguire.

The Trust reported on Wednesday 2 February 2022 that Southall had written to them saying that "We have received an email from Matthew Southall with a statement from Morton House this afternoon that was being circulated to both local and national media."

Now I am not as tech savvy as the kids today but I've seen one media outlet publish anything from Morton House in the last 96 hours.

Not one.

Southall and Jarvis, the ignorant pr*cks that they are, have posted on this message board under various pseudonyms for months and have clearly forgotten about the one article that actually matters.

And here it is:

Ben Rumsby. Daily Telegraph. 5th August 2021 at 5.24.

https://www.telegraph.co.uk/football/2021/08/05/efl-investigating-homophobic-slu

Specifically this bit:

Curran did not respond to requests for comment after the claims against him were put to him via text message.

That followed a bizarre phone call with Telegraph Sport in which he said he had “nothing to do with Rochdale”.

The call nevertheless prompted a WhatsApp message from Alexander Jarvis, who described himself as an adviser to what he admitted was a “hostile takeover” and said that Curran was “a bit of a recluse”.

Alexander Jarvis, the gift that keeps on giving. Curran stated he "had nothing to do with Rochdale", but had been to an EFL meeting on the 29th July where he made a homophobic slur and was banned from football!

https://www.thefa.com/news/2022/jan/11/curran-suspended-110122

Either Curran lied to Ben Rumsby or he had a very bad memory about meeting the EFL meeting he attended the week before.

The EFL then charged them all on 16th August 2021 and told us here:
https://www.efl.com/news/2021/august/efl-statement-rochdale-afc2/

The EFL must read the Daily Telegraph!

There is zero chance of anyone Dale fan or otherwise including any other journalist being done for defamation for using the phrase "hostile takeover" as it was uttered from the lips of brave Alexander Jarvis and reported by one of the biggest and lonstanding newspapers in the world.

Matthew Southall then admitted to the Trust thata he and Alexander go WAY back:
https://www.daletrust.co.uk/2021/10/10010/

Southall began by stating that he was contacted by Alexander Jarvis on behalf of Morton House with a view to a purchase of the shares. He said that he had known Jarvis for a few years and the pair had worked together before including at Charlton. Jarvis had told him that he had a deal that had “gone wrong” that might be of interest Southall.

Looking forward to seeing the Daily Telegraph take that article down Matthew.

Threaten to sue them for defamation and see what Ben Rumsby, the Daily Telegraph and the Daily Telegraph's lawyers say........

"What Is a Hostile Takeover?
The term hostile takeover refers to the acquisition of one company by another corporation against the wishes of the former. The company being acquired in a hostile takeover is called the target company while the one executing the takeover is called the acquirer. In a hostile takeover, the acquirer goes directly to the company's shareholders or fights to replace management to get the acquisition approved. Approval of a hostile takeover is generally completed through either a tender offer or a proxy fight"

The funny (ish) thing here is that MH thought this would be a push-over as Bottom had told them how to do it and given them encouragement. Hence, they (MH) didn't regard it as hostile, they thought they were pushing an open door until the EGMs and the fans slammed it shut.

Of course the Trust or a Director could try to buy up the shares in MH if only Safouane Faisal could be found, he might be amenable to a cash deal for 51 shares!! It could even be cheaper than defending the High Court case!!

When this gets to court, I'd imagine that the submissions will have to make some candid references to how the "hostile takeover" was actually performed in July 2021 and what the EFL knew as background for the casual reader.

Court documents are ultimately public and so then we will know what has been submitted.

The last thing that David Bottomley, Alexander Jarvis, Matthew Southall and Andrew Curran will want is a warts and all disclosure of who did what when, who knew what when and who might need to come and sit in the box under cross examination when. These things are often supported by bundles and bundles of backing documents.

Who knows - it might actually give the EFL something to read that helps them understand 8 months into their own investigation!

The ironic thing about those 4 names is that none of them are actually "Morton House" so we can call them to support the case for the defence and so can the prosecution.

Now David Bottomley, Alexander Jarvis, Matthew Southall and Andrew Curran might not actually want to come and give their view, under QC cross examination from both sides, but that is for them to deal with if called. Effectively all four of these people are now members of the public.

But if they are named and fail to show that will be point proven. High Court Judges are notoriously picky on the details.

Here's an example of a High Court claim decided:
https://www.bailii.org/ew/cases/EWHC/TCC/2020/3389.html

In the section on "The witnesses and their credibility" the judge will have to make an assessment on all who appear before him/her and the quality, veracity and honesty of all submissions.

I think that because he is a karma_comedian kel.

He comes and goes.

To answer the OP, I think there is very little interest in Matthew Southall and that the public at large think he is a toxic individual not fit and proper to be involved in any football club at any level.

If he was the landlord of my pub team, I'd change where I drank!
