This means that his actions could or may well cause a breach of the peace and not necessarily by him but by others as well either in support of him or otherwise. Robinson didn't commit a breach of the peace at any point. He was detained as I see it to prevent one.

Not really, breach of the peace is related to harm which was actually done or likely to be done to a person or, in his/her presence, their property.Otherwise the police could just arrest anyone they didn't like the look of Prevention of breach of the peace would have to prevent this happening, but after any incident had taken place it would not be prevention. As neither occurred then it wasn't relevant.

I don't know where you got that from but it's totally wrong. Police can and do arrest people disturbing the queens peace and place them before a magistrate to be bound over to keep the peace. More often than not though they are kept in the cells until everything cools down and they are released. This is not strictly the way it should be done but the more pragmatic approach. Under your explanation you would take a ruffian away let him go, he could return, take him away again ad finitum. He was undoubtedly arrested under these circumstances to prevent a BOP and then for the more serious contempt of court matters when in custody. Matthew Harding is not a barrister he is an advocate ( a qualified solicitor with rights of audience)

We established many moons ago tha if anyone relied on our “Controversial” chum for any kind of legal guidance they’d likely end up doing a considerable stretch in pokey. He’s utterly clueless but so convinced of his knowledge it’s touchingly amusing.

It is now widely accepted that the correct definition for breach of the peace is that which was given in the case R v. Howell (1981), ie, that the behaviour of the person involved caused the police officer (or private citizen) to believe that: a breach of the peace had or would occur; and that it related to harm which was actually done or likely to be done to a person or, in his/her presence, their property. That's all it is, no mystery at all.Taking photographs or recording in public of anything is not a breach of the peace, it doesn't even come close.
