Ultimately,as Metallica correctly pointed out,the mask's veneer cracked and he threw away all his previous reasonably coherently argued,if mistaken,positions and quickly took a good old LFW feeding frenzy battering as it became palpably clear for all to see that he'd thrown it all away & after being cool & contained for so long,his last post finally contains some rather weak pathetic,personal abuse - ooh he called us girls,how dare he? If/when the FA get invovled they made it clear in the Suarez case that context doesn't matter, Suraez meant it as a joke I think but they banned him and fined him. Terry can use any one of his three stories but it shouldn't matter if the FA are fair and consistent, I know i don't think they will be either. If they do stick to the same punishment though he'll get a 4 game and I think his first game back will be at Loftus Road due to the Chairty shield game.


I sometimes wonder whether there is a possibility that at the FA HQ, they are having a secret laugh at our expense. If that is correct about a four match ban, then you just couldn't write a better script.

Seriously annoyed I cant get to this game, as it is likely to be as lively as last year's if Terry plays, particularly as I believe we have a team that is more able to compete against the scum. or will it be a repeat of the cup bore-fest

I think Anton said he didn't hear it at the time, but that his girlfriend showed him it on YouTube shortly after the match and he was then upset by it. Sorry for delayed reply, I'm a solicitor generally dealing with crime. I do not remember what I posted about the Faurlin saga but I was confident we wouldn't get docked points due to right of appeal causing mayhem.

My principle concern regarding the press is that they won't fillify him at all and we will see a "John Terry - my ordeal" story in the sun with pictures of his recent charity drive in Africa!

Although at court today many solicitors expressed surprise about the delay announcing verdict, general consensus is that there may be a case of trying to find a way to find him guilty irregardless of the clear reasonable doubt. Anyone who thinks that this doesn't happen in law would be very mistaken. Experience tells me that the longer they need to think the worse it is for a defendant. the exact opposite to how juries work at the crown court. There may be some hope afterall then!

So any person who saw that YouTube footage could report it to police and they would investigate as they are duty bound to. This is quite unique to racist incidents

I fundamentally don't believe Terry is a racist, but I KNOW that he is thick as Pig Shit. He, and his team mates TOTALLY lost it in the game in question; I think Clive said at the time they got upset because 15,000 people were shouting nasty things at them. We all know that they had two sent off, but could so easily have had four or five sent off they lost it so badly.

He did use the language, it was clear to see and his defence simply doesn't hold together - "I say Anton, did you think I called you a ...." REALLY?

Still that said, there's a good chance he'll walk free as I can't help but think this has been dodgy from the start. If it were any of us in court who had an extremely important task on at work (and I am sure that in the whole scheme of things 80% of us do could have something more worthwhile than Chelsea in the Champions League and England in the Euros), do you think a Judge would have put it back five months to suit?

Then the FA will do FA other than probably charge QPR with something like: 'wasting a Big Four Club's time' and then punish us when handshakes are again refused with the Scum and their captain.

The character witnesses in the trial are exactly that, just about his character, not the actual evidence. It's just trying to convince the magistrate he's a decent bloke. You have to have faith in the magistrate in a case like this. They're highly intelligent impartial people who will listen to the evidence and assess it properly, unlike a jury who are far too open to manipulation by barristers. In a magistrates court case the character witnesses are pretty pointless.
My problem with this is that if he's found not guilty it gives the FA the perfect excuse to hide behind the verdict and say here's nothing they can do, when the evidential test in a legal court is a completely different burden of proof to theirs, which I imagine is balance of probabilities as opposed to beyond reasonable doubt

If I called you a FBC and you never heard it but someone else did and reported it on your behalf It would still get investigated. The fact is that Ferdinand has provided a statement to police as the victim and the fact that he doesn't hear it at the time doesn't really matter now. There's no need to call the person who reported it as the footage is in the public domain and all he/she did was set the wheels in motion.
As to the bit about things being recorded in private conversations it's a bit of a minefield with the human rights act, right to privacy etc. but there have been many cases of people having private conversations recorded secretly leading to their undoing, not necessarily in a court, but certainly through tabloid newspaper stings etc.

JT did use insulting words. They did cause alarm or distress to the member of the public who reported it.

This offence has the following statutory defences:
(a) The defendant had no reason to believe that there was any person within hearing or sight who was likely to be alarmed or distressed by his action.
(c) The conduct was reasonable.

There were people within hearing/sight who were distressed by his actions. His conduct was not reasonable.

VERDICT - Guilty as charged.

Exactly Derby - defence have done well if they introduce doubt, as I think their argument of context and only apply to whether the "conduct was reasonable" or not.
