it's not if you appeal and fail, it's if the appeal is deemed 'frivolous' - which this clearly wasn't. |
It took them 1 day to reject the appeal,less then that if you think they have to get all the appeal committee out of there old peoples homes and together to here both sides of the appeal.
If thats not them saying it was a frivolous appeal then nothing is. |  | | |

In Courts of law, any previous convictions the accused may have are not allowed to be disclosed. The case has to be tried purely on it's own merit.
Is this the same with the FA or is it a case they'll just use that 'unofficially'?

Was just about to say the same thing.
If I can offer a balanced view, he hasnt done himself any justice by banging on about legal action against officials using the Twitter thing.
And...what goes around comes around - think back to the first game of the season with him and pingpong or whatever of Arsenal.
And... the FA are probably still p@ssed at us over the Faurlin affair.
Time for Our Joey to through his bladdy mobile away, get off Tw@tter and get his head down and concentrate on keeping us up when he gets back.

Agree with Drewster and Neil on this. There are a lot of factors here, and we really could have been more clever on our handling of it in three ways:-
1) Barton shouldn't have given Johnson the chance to cheat
2) He shouldn't have twittered after
3) Warnock shouldn't have used the word cheat
I've no doubt we were wronged, but it's never enough to be right. You also have to win. And we've lost this one.

the fa should base the outcome on the incident not what people have said since. How they have come to this conclusion is a joke.
It seems the less officials see the longer the ban in both this and the Suraez case.

Bit of an urban myth that as well I'm afraid.
From the Laws
"He (4th Official) assists the referee to control the match in accordance with the Laws of the Game. The referee, however, retains the authority to decide on all points connected with play." |
From The Laws of The Game, specifically:
"The Fourth Official is also responsible for indicating to the Referee when the wrong player has been cautioned because of mistaken identity or when a player has not been sent-off, having been seen to be given a second caution or when violent conduct occurs out of the view of the Referee and the Assistant Referees. The Referee, however, is ultimately responsible for deciding on all points connected with play."
Don't think anyone could say the incident took place out of the view of the Ref and his Assistant. Unless they had their heads up each others @rses at the time.

Probably repeating something already posted, but Dermot Gallagher explained yesterday that Assistant Referee had made complete "Horlicks" by not flagging and just shouting down the Refs earpiece "stop the Game".
As Ref did not see it,and Lino did not flag it, Dermot explained that justifying the sending off would be nigh on impossible.

I think part of the problem is that Barton made some rash comments on Twitter about potentially suing the officials for the decision, which probably hasn't sat very well with The FA.
It's also very risky to label players as cheats, as Neil Warnock did in his press interview after the game, however he feels. So none of this stuff helped our case with The FA, not that you'd have any confidence in them in the first place. |
No outside influence is taken into consideration in an appeals process, you'd be surprised how blinkered and insular these people are. |  |

I can't help feeling that the FA hearing back in April / May of this year has something to do with our unsuccessful appeal.
If the rumours were true and the FA believe we had backed them into a corner with threats of legal appeals should they impose a points deduction, then perhaps the only real surprise here is that the ban was not lifted to four games.

Certainly because 16000 paying customers were cheated
Certainly because a team in the lead lost and lost 3 crucial points
Certainly because there was no contact by JB
Certainly because there was not even a yellow card for an oppo player
But more than all of this that the message to all who play the game, particularly the kids, that feigning injury and cheating and even gloating about it afterwards is a good thing and and will get you what you want so carry on....

I'm surprised that anybody is surprised at the appeal being turned down.
