| Forum Reply | Are there any people who mingle with real fans on the Trust? at 21:50 10 Sep 2018
Its not hard or intriguing to get to 7 ? There was Phil and Stuart on the podium. The 2 ladies at the back are longtime trust. Phil pointed at a front table with 4 or 5 sitting there and named one of them and another was the legal man. Of the others sitting there 2 are recognisable from their trust website pictures. And I said at least 7 because maybe there was more trust in the room. Just trying to help respond to the OP that the trust “mingles with real fans”. |

Phil please can you answer the above question: “Can you explain why you think the inaction of the Trust in a timely manner after Americans 2 has not reduced the likelihood of success from future legal action? I would say the yanks lawyer would argue that the Trust accepted the situation as judged by its inaction, the Trust board negotiated a weak deal structure with the yanks that sets an unhelpful precedent, and value of the club after relegation is now a fraction of what it was when we were in the Premier League.” I believe I have seen you say on here in the last week or so that you now believe the Trust should sell its full 21% shareholding ... do you really think this would be ascribed the same value as at the time of Americans 2? |

Dave please can you explain what "our legal side" of the Trust means? Does this mean Dai Little? Or a sub-group of the Trust Board being advised by Dai Little? If so what are the names of the sub-group of Trust board members who are dealing with the mediation process? |

Phil thanks for responding. I’m sorry I can’t trawl through all the threads here to find answers to what you have answered before. As you say, the statement will have to do. You said you expected some flack Phil and I am genuinely interested in your response to my questions below to help inform the voting. I am surprised Phil you are standing. Please can you explain why, as Chairman of the Trust board last year, you authored the astounding document that recommended Trust members should accept a poor offer from the owners and not vote for legal action? That document issued under your name was one of the most naive, one-sided, and farcical assessments of pros & cons I have ever read. Like sheep the majority of Trust members duly followed your direction and further cuckolded the Trust. Both before and after Americans I and Americans 2 arrived on the scene during your tenure as Chairman, the failure of the Trust to adapt over several years from a fund-raising feel-good society (useful in its day) to a hard-nosed body to represent the interests of supporters on the important issues cannot be a happy legacy for you. What would be different from you if you rejoin the Trust board? Has your judgement improved over the past 12 months? Can you provide some assurances that you have the courage and energy to pursue legal action against current and former owners this time, and with urgency? The inaction of the Trust board under your tenure has reduced the likelihood of success and financial value of legal action. This is still however a fight that needs to proceed as soon as possible in my view. Thank you for your time. |

Shaky - thank you for again laying out this clear and actionable position. Why do you think the long-time Trust Legal advisor in the form of Dai Little does not seem to see things as this straightforward, given the path of not taking legal action that the Trust has chosen to follow to date? |

I know things like this are sometimes hard to accept. M Morgan (and R Davies) were centrally involved from the start of Americans v2.0. This may yet be clarified publicly through legal processes. |

I hope SCSA will motion for a donation from the Swans Trust at the upcoming AGM? Seems very reasonable as SCSA is doing some work that the Trust should be doing. |

It is hard to believe there is no AGM date set (even provisional) as the AGM should be held by the end of January per governance rules. The Trust seems very unwilling to disclose the AGM date. This is obviously very inconvenient for people who have calendar/work commitments and want to attend. This is surely true for at least some Trust board members themselves. I have previously asked the Trust Secretary for at least the provisional date but no reply. |

The Trust board should indeed be the single strong representative of supporters interests. The problem is that the Trust board, stacked with long-serving board members out of their depth, did not read the landscape and develop a strategy at the time of Americans v1.0, and then missed or ignored the arrival of Americans v2.0 and thereby frittered away the Trust’s clearest opportunity to negotiate/influence the future of the football club. History will not judge the Trust board from that timeframe kindly. It is just maybe not too late for the Trust board to redeem itself and take decisive legal action, but we are nearly at midnight. We will see very soon whether the injection of new members onto the Trust board has enough influence to turn the tide. |

This is exactly right. This time Dai Little and the Trust board should recommend litigation to members and proceeed accordingly. This is what the Trust board needs to focus on doing. |
