Following on from the confirmation on Friday that faceless payroll company Morton House are looking to take legal action against the club board of directors and trust (& so by proxy our fans and community), we want to remind the public of some of the key questions related to the failed hostile takeover of RAFC by Morton House Management & First Form Construction Limited.

We started last night by asking:

- Why did Andy Curran / Darrell Rose (Morton House) PRIVATELY pay 3x market value for shares in #RAFC?

- Why was Matt Southall seen with Morton House at the Crown Oil arena in APRIL?


The purpose of this thread is to find out what outstanding questions you have. There have been loads asked on various threads (that can be found on the Hostile Takeover thread) and we know there are lots that haven't been mentioned yet. Post your questions below and we will collate them from here / FB / Insta / Twitter, and ask them publicly across all of our platforms - tagging in the EFL, HMRC, SRA and any other relevant people / bodies to questions that are related to them.

We want to keep our club fan owned, at the heart of the community, so any questions we have that can be kept in the public conscience (and potentially be asked by the multiple press agencies that are again taking an interest) can only be a good thing.

Who is Faical Safouane? Does he actually exist? He owns MH and keeps Courtnell as a Director... but who is pulling the strings? If Safouane does not exist none of what has happened is legal anyway.

Who has signed the High Court order on behalf of MH?

Why isnt the MH owner pursuing former Directors for wasting company money on buying a minority shareholding in a football club at highly inflated prices?

A good question. I would suggest asking those who sold their shares...Who signed the cheques or where was the cash transferred from? And if it came from the MH Solicitors, who told them to transfer the cash?

When will the EFL actually step up and conclude their investigations. They are just kicking the can down the road hoping they won’t need to get involved and the problem will just go away.
And when will the results of these investigations be made public?
There is currently more than enough information available in the public domain for them to declare all parties involved in MH as unable to pass the “fit and proper tests” which bars them from having anything to do with the club. Make public the fact they are all barred from having any ownership and nullify any shareholding they think they have.

That, to my mind, would be the basis of a claim for compensation for the failure to act by the EFL

On what grounds are they suing the trust and club?

They bought the shares through a private transaction with certain individuals. The only part the club could have played is to carry out the share transfer, however A) they didn’t present them B) they were advised by the EFL not to sit them.

Also what direct interaction with the trust have Morton house had that could be subject to legal proceedings?

so morton house tell the efl they will "divest" their shares because they screwed up their "hostile" (alexander jarvis's words) takeover last august. they wanted out, because they were shite scared of an efl investigation, (wonder why?, there's a question) so why the high court

football nomark alexander jarvis told football nomark matt southall about a deal that had "gone wrong" at rafc. neither of them are listed as past or present shareholders or directors at morton house. what has
it got to do with them? the judge will want to know. morton house is a 78 year old woman with a criminal record and a bloke who works for argos
who "claim" to hold shares in rafc, but went about the transaction the wrong way in breach of efl rules. not one person in the game of football trusts morton house, a shell company, no more. any judge will see that.
so my question is, morton house, what are you up to?

what's the beef of the 78 year old woman with a criminal record and a bloke who works for argos who have never legitimately owned a share or shown any interest in the club? are they a front for criminals, jarvis, southall, bottomley, curran, rose et al or two irrelevant people with
bad intentions? the judge will want to know.

my legal eagle says we'll have to wait for the precise written details of the action to be revealed to know what they are really up to, but the solicitors and (he guesses) the qc behind it are going to look a right set of balloons at the end of it! reputational damage and all that.

EFL are pretty useless and only generally get involved in sporting matters,they were completely powerless to stop Stewart Day transferring ownership of Bury to Steve Dale for £1, he failed the fit and proper test yet they did nothing and only got involved at very last minute when it was too late. Don't expect anything from the efl.

FWIW, i referenced their failure to act in the Bury saga in my email to them

I don't expect them to act now, either, but i do expect repercussions for the EFL at some stage. We can only keep on their case; we're pretty good at that

Faical Safouane - 100% owner (since 20th August) and the driving force taking legal action against little Rochdale, its supporters trust and the fans.
Says he lives in Slough but doesn't. If you go to Flat 3 Eton Walk, 2 Upton Park, Slough, England, SL1 2DP (as listed at Companies House for his 2nd company with Denise Courtnell called Coleman Management Services Limited), they have never heard of him.
