Hi,
Wonder if any of you can help?
Last year I was working as a recruitment company, it was a mess And I was doing 90 odd hour weeks etc. to make it even legal (class 1/2 drivers with no licence checks etc).
I left for an agreed holiday to South Sudan and returned to a very light payslip and p45.
When I questioned this, I was good that I had resigned!!!
I have been asking for evidence of my resignation, which I have never received, just been told that as far as the owner of the business is concerned, the matter is closed and we should move on.
Now, I thought records had to be kept for a minimum time and also question if someone had fraudulently made a fake letter of resignation?
I'll be honest, they are a scummy company, screwing people left right and centre.
What can I physically do to get to the bottom of this?

You need to get your stories timeline sorted out, Dates, Contract of Employment, Letter of offer,Employment history with this company, any relevant correspondence etc, etc and then call ACAS in the knowledge you can send them the relevant information that supports your claim....which is unclear....Wrongful Dismissal...? | | | |

GanjR,
I would still look to make a request under the Data Protection Act about all of the information they hold on you. They do have to comply under the law and should have at least some records on you even three months later (even if its just payroll).
It doesnt cost a great deal to do and if nothing else it should start them thinking. If they chose not to comply or respond then ICO does have to play a role. |  |
