And it's not that the job doesn't exist, it's that the club prefer someone else to play. So simply cancelling the contract would be a clear breach and the player could claim damages. On the assumption that the contract is fixed term for fixed money, the 'loss' for the breach is the lost wages over the term. There will be a few more subtleties to it than this, but this is the gist of it. Most employees don't have fixed term contracts for a number of years in roles that can't really ever disappear. | |

If they have deep pockets and a real desire to trim the squad, then they would enter into negotiations with a player to hopefully terminate the contract by mutual consent. The club would be forgoing any possibility of a future transfer fee, and the player would be 'free' to join another club without the need for a transfer fee, which should (in theory) increase the wages they would be likely to attract. Whatever they received would also be paid upfront and would be in additional to the wages they get at their new club, so should be an attractive position for them - money for nothing, in effect. All this said, the club would still likely have to put its hand in its pocket to some extent and would lose out on the transfer fee, and there now seems to be a consensus on here that our club has nothing in its pockets anyway. | |

The club could claim damages from them. No new club would sign them until they were clear that any previous contract had been properly terminated. Rules in relation to contract are there to make sure that both club and player have some medium term security. Important in terms of building a team over a number of seasons and (from the club's perspective) making sure that the person they pay a whopping transfer fee for is actually going to play for them for a few years. | |
