Notice of Intended prosecution 09:40 - Oct 15 with 9911 viewsjack_lord

What a start to the day.

Wife has had a notice of intended prosecution for not wearing a seatbelt.

Almost certainly that was me because she never drives when I have a week off and she wouldn't drive without one.

What we call the speed camera van probably caught whoever was responsible.

What I am actually saying is don't drive without a seat belt because those vans aren't just there to catch you speeding.

We may not all agree that we have commit ed an offence. We may have transgressed some form of legislation, but we don't all feel like criminals if we have gone an extra mph over the speed limit etc and nobody has been harmed. That limit may be increased or decreased the next week.

There are hundreds of thousands of so celled laws and statutes, it's impossible for anyone to know them all even judges and barristers.

If I have committed some infringement, i will try my best to get around it, however If there is a victim and some injured party, and I know it's my fault then I will put my hands up

Cancel that, I read it wrong.

The ticket will tell you which camera clocked you and the time so you’ll be able to work out where on the map in relation to the pub the camera was.

The ticket says the name of the road outside the pub, it was about 1 ish when you were dropped off. The offence was committed at 1PM. Who was driving?

Ask for a copy of the photograph/evidence and it will be clear, if it isn’t ask which way the camera was pointing. These are all questions that should be answered.,

That would be a arguable defence, but if you drove to the pub and your wife drove away, the position of the camera should,be able to tell you, as it either be before or just after the pub.

If it before (as in you were driving TO the pub,) it’s you. If there is also one (bearing in mind they only flash one way) driving away from the pub, it’s her.

If there are two camera, on either side of the road, explain this in your reply and ask them which one it is. If they do, you can explain if not, they cannot prove it,

On another point, either reply by recorded delivery or take a video, picture of you posting it, or have a witness with you, in case it goes missing

This is hypothetical. It was suggested above who doesn't know who was driving their car. The camera will confirm in any case.

It did actually happen to us about 10 years ago on a Saturday evening when a similar scenario occurred. Turned out it was my wife who was driving but I nearly got the fine and the points.

On reading this snippet "If I have committed some infringement, i will try my best to get around it, however If there is a victim and some injured party, and I know it's my fault then I will put my hands up " Then I'd say that's the last thing you'd do . Not willing to pay up when you know you're guilty and the offence is of a minor nature but willing to admit your
guilt when the punishment could be greater , don't think so

I did speed awareness course in Cardiff about 3 years ago caught doing 75 near Bristol junction coming to Swansea from Heathrow around 2am in the morning.

I'm sure the course was around half a day. Sitting listening to presenter talking to everyone like little children. Some people got wound up by it all, but I just sat there let them waffle on and then got out of there. There was some interesting info as well.

They do watch for peoples attitudes so being obtuse will not go down well. Best to just sit there look like you are listening and then leave.

Has to be done online now. £92. 3 hours.
Nice moneymaker.
Friend was doing 34.4 in a 30mph. In a line of traffic.
He got done, and presumed the others did too.
The course tutor told him that they will do you for doing over 10% plus 1. So he was 0.4mph over the poor bugger.
He is 72. Has no hi tec besides a basic phone.
So had to borrow someone's iPhone to do the course.

Swansea Indepenent Poster Of The Year 2021. Dr P / Mart66 / Roathie / Parlay / E20/ Duffle was 2nd, but he is deluded and thinks in his little twisted brain that he won. Poor sod. We let him win this year, as he has cried for a whole year. His 14 usernames, bless his cotton socks.

The OP is about the NIP for not wearing a seatbelt (caught on cam) and the course 30 minutes with the fine mentioned.

Honestly. Please don’t. Seek representation from a criminal solicitor (don’t need a specialist road traffic one)
